Issue: Chimineas/braziers on residential property

Part 5, Clause 5.2 (4)

Current

Open-air fires are currently prohibited without a permit, other than when cooking food in a properly constructed barbecue.

Proposed

Expanding the existing clause to allow for the use of chimineas, fire pits and braziers on residential land, for the purpose of heating.

Rationale

Outdoor living spaces are becoming a more common feature of urban living, and a wide range of suitable products have entered the market which allow small fires to be safely used in these situations.

This new clause seeks to recognise the need for heating such areas in ways that also create ambience and, in many cases, recognise cultural traditions or religious observances.

We are satisfied that both the proposed local law and existing state legislation have controls in place to manage any health, safety or amenity issues that might arise from the use of chimineas, fire pits and braziers.
